Where suppliers stand

When a liquidator is appointed, the company's assets are frozen and sorted by who has a registered claim over them. Suppliers who registered a security interest on the PPSR before 21 Oct 2026 are secured creditors over the goods they supplied and, with the right terms, over the proceeds of those goods. Suppliers who didn't register are unsecured creditors, and ASIC's statistics show unsecured creditors receive less than 11 cents in the dollar in around 96 per cent of liquidations.

What to do now

  1. Find any correspondence from Example Partners: the initial notice to creditors sets out how to lodge a proof of debt and whether a meeting will be held.
  2. Lodge a proof of debt for everything you're owed, with invoices attached. It costs nothing and it's how you get a vote and a share of any dividend.
  3. If you registered on the PPSR, write to the liquidator asserting your security interest, quoting the registration number, and asking for your goods or their proceeds to be accounted for separately.
  4. If you had equipment on hire there, do not collect it without consent; ask for it in writing, citing the registration.
  5. Register every other customer this week. One collapsed customer is the moment most suppliers find out they were never protected.

This page explains the process and the dates. It doesn't assess your claim or tell you what you'll recover; for that, talk to a lawyer or an insolvency practitioner. See also: Retention of title for suppliers to retailers.

Common questions

I supplied goods to Example Retail Stores Pty Ltd and haven't been paid. What are my options?

Lodge a proof of debt with the liquidator so you can vote and share in any dividend. If you registered a retention-of-title or PPS lease interest on the PPSR before 21 Oct 2026, you are a secured creditor over your goods and their proceeds and should assert that claim in writing to the liquidator as well. If you didn't register, the goods have vested in the company and your claim is unsecured.

I have equipment on hire at their premises. Can I collect it?

Not without the liquidator's consent while the appointment is in place. If the hire was registered on the PPSR, write to them asserting your security interest and asking for the equipment's return or for adequate protection. If it wasn't registered and the hire was a PPS lease, the equipment has vested in the company.

Can I still register now?

Not for Example Retail Stores Pty Ltd: a registration after an insolvency appointment doesn't revive an interest that has vested. You can and should register every other customer this week; the free check will show which ones aren't covered.
